MyJotter.com Limited is willing to supply you with the MyJotter voice-to-text messaging service ("the Service") subject to the following Terms and Conditions.
1. Your Obligations
1.1 To provide MyJotter with true and accurate information about yourself and, in particular, to provide a valid name, email address and mobile phone number enabling us at all reasonable times contact you.
1.2 Not to send voice-to-text messages that are in our sole opinion unlawful, obscene or otherwise offensive.
1.3 Not to send unsolicited marketing, advertising or promotional messages for commercial purposes.
1.4 Not to-resell, re-badge or exploit commercially in any other way the MyJotter Service other than with our explicit written permission.
2. MyJotter's Obligations
2.1 To provide you with access to the MyJotter Service as from time-to-time defined on the MyJotter website www.myjotter.com and to provide you with password-protected access to your own private information on the website.
2.2 To keep confidential your personal details stored on the MyJotter website and not to use those details for any purposes other than the operation of the MyJotter Service.
2.3 To keep confidential copies held within the MyJotter website of your voice recordings and the corresponding transcribed text.
2.4 Not to divulge your personal details, voice recordings, or corresponding transcribed text to third parties for advertising, promotional or any other purposes except as required by law or statutory regulations.
2.5 To comply with the Data Protection Act 1998 and subsequent amendments if enacted.

3. Limitation of Liability
3.1 You agree that MyJotter provides the Service on an "as is" basis and that MyJotter will not be held responsible or liable for the consequences to you or to third parties of faults, delays, interruptions, mis-deliveries, lost messages, lost data, quality of transcriptions, all adverse events whatsoever affecting the normal day-to-day performance of the Service, and all force majeure events beyond its reasonable control.
3.2 You agree that MyJotter will not be held responsible for the error-free transmission of messages or other data through third party systems beyond its reasonable control, such as data communications systems, mobile and fixed line telephone networks, and the Internet, nor for the loss of, mis-direction of, or security of, the data thus transmitted.
4. Termination
4.1 MyJotter may terminate this Agreement, and at the same time your access to the MyJotter Service, at any time without notice and without necessarily providing a reason for so doing. MyJotter's termination of this Agreement will not remove your rights to receive from MyJotter any net credits owing to you.
4.2 You may terminate this Agreement, and at the same time your access to the MyJotter Service, at any time without notice. Your termination of this Agreement will not remove your liability to pay Myjotter any net debts owing to them.
5. Law
5.1 This Agreement shall be governed by the Laws of England and both parties agree in the event of a dispute to submit themselves to the jurisdiction of the English Courts.
